advice please CCJ

has anyone have any experience with ccj. one of the banks i owe money to has send me a letter that says that have applied for a county court judgment against me. i am in the process of registering for bankruptcy. Can they take my belongings and sell them.really scared any advice?

I think you need to turn up to the hearing if one is set and then you can defend yoursefl- but before that, ring the numbers on the letter and the banks and talk it through. If you have tried to pay off the debt and made reasonable efforts, even if they do decide in the end to take you to court it will look a lot better for you.

but if I call the court and the bank and explain that I can't pay and that i am in the process of registering for bankrupty what whould they do? still expect bailif on my door? is there bound to be a hearing before they come knocking on my door?waited too long I think.thanks you please tell me more

you need to write. Get EVERYTHING in writing and keep a file.
The bailiff cannot come until there is a CCJ in place and remember, they cannot exclude you from the hearing. And up until then, you have every right to enter dialogue with them and explain your problems.

I'm not a court official but I do hear that courts tend to look favourably on people with children (as I assume you are?) who have made all the efforts they can to pay and/or communicate with their creditors.

a tip- if you do have to speak to anyone (and I don't recommend that, far better to get it in writing) always take a note immediately of what was said/agreed, the name of the person you spoke to and the time and keep it in your file.

from the moment they apply how long does it take for the ccj to actually come in place. I have just received a letter 5 days ago but have not contact them yet. I have just spoken with a company who will help me with the bankruptcy but it takes time and I don't want my house to be emptied in meantime by the bailiff.

write summarising your entire situation, any payments you have made, how (if at all) you responded to earlier letters. State how you intend to pay if you have a plan, if not say that you want to come to an arrangement but at the moment you do not have available funds (you need to be able to prove that) but that you want to work with them to find a solution, etc etc.

re. the ccj not sure how long it will take for them to get a court date. You would get a summons to appear. I expect it would be at least 8 weeks from now, plenty of time to contact them and halt the court action.
