Is this fraud?

Hi,

A comment from a friend has got me worried! I have a credit card that I use regularly. It's a card that is in my mum's name, but I use it and pay the bill etc. Mum fully aware and happy with this. I couldn't get my own card as exdh destroyed my credit score.

I use the card regularly and always thought this was fine as I have mum's complete consent. A friend has commented that what I am doing is fraud and that I could get into a lot of trouble.

is this true?

Your mum should have a 2nd user card for you rather than you using a card with her name on

I do exactly the same with my mums card with her consent! Also due to ex destroying my credit rating.

I wouldn't say it's fraud at all as you have your mums permission. Not sure who would care that you are doing it. Your mum hopefully is aware though that if you stop paying for any reason or miss a payment then it will affect her credit score should she need to borrow in the future.

It’s not fraud as there is no intention to deceive however it is against the Ts and Cs and if the bank finds out that your mum is not protecting her details they may choose to close her accounts.

If her card is ever used fraudulently it may also cause difficulties as she has given her details out so the bank may not refund.

In what way would this be fraud? It's her card. You have her permission to use it. She is ultimately responsible for the debt. She is (presumably) aware of this and has the ability to consent to it.

It's probably one of those things where it's outside the card agreement but it's not fraud and would only be an issue if your DM decided to tell the card company that you'd used her card without her permission. So as long as that doesn't happen, you're fine.

It’s not fraud as your mum is aware that you’re using the card.

However, it is likely to be against the terms and conditions of the card.

Also if the card is used fraudulently the bank are unlikely to pay out as she has knowingly shared the details with other people.

And if you fail to make the repayments then it is her credit score which will be affected.

I can see why you do it but it’s really not a good idea for all of those reasons.

Could your mum get you a second card instead of using her’s?

It's not fraud but she is almost certainly breaking the T&Cs she agreed to when she took the card.

This usually causes issues when there is actual fraud on the card, the bank discover she has not kept the card and PIN secure and therefore refused to recompense any losses.

My daughter has a 2nd card for mine and doesn’t live at my address. Yes the card was sent to my address as it’s the account address but the card has her name on and there was no stipulation she had to live here

I think the thing here is to not divulge your financial affairs to your nosey friend.

If it’s fraud then thousands of people would be charged, my family use my card when spending on Amazon, DH takes my card to draw out cash, I take my DS’s card to buy things that he wants.

You are breaking the T&Cs you signed up to & would potentially regret it if you were actually a victim of fraud.
Much better to ensure only the cardholder uses their own card then transfer any money owing between bank accounts.

I don't think what you are doing is Fraud OP but you need to be careful as it breaks the T's and C's of the card.
It would also be worth getting your Mums permission in writing as if anything happened to her or she lost capacity it could be claimed that you took the card without her permission (although I appreciate that is not what you are doing)

That’s why I did it the way I did and got DD her own card for my account
