Whose money is it?

DH and I have multiple savings and investment accounts. Some are in my name, some are in his. No joint account, but joint mortgage.

If we were to split, would the cash in these accounts be viewed as shared assets, or would the money then belong to who ever holds the account?

I always thought that assets were shared when married (unless there's a pre nup) so regardless of who's name is on there we would split it down the middle. He thinks that any money he has transferred to my accounts would be viewed as 'gifts between spouses' and is therefore mine (makes me want to do an evil cackle)

We're not splitting up fyi, just for some reason chatting about it 😂

It’s all in the pot of “marital assets” so it belongs to both of you upon divorce, not either one of you
