Hi I wonder if anyone has any words of advice for me please. I bought a games console last year, and it’s faulty. It was a console with a game, on an offer. I asked for a replacement… but have been given a full refund as ‘ out of stock’ great… but it’s now an updated model. And the new one is more expensive! Another £100. How do I stand? Great they refunded me. But I can’t buy it now as old model and new one is £100 more.
should they replace it on a like for like basis as not my problem it’s not on sale any longer? I don’t want pay more money out when not my fault it’s faulty. I’d appreciate any words of advice, thank you

I think they've fulfilled their obligation by refunding you for the faulty product. I don't think you're entitled to a like for like replacement, unfortunately.

Which console?

As annoying as it is, you will benefit from buying the newer model because it will take longer for it to be obsolete.

Yes it’s great they refunded me, but should I have to fork out more money to replace it due to it being faulty. Should I, as a customer with a faulty item, be in that position?

The older model is no longer in stock so they have refunded you because they can't provide a like for like replacement. Like for like would be another console of the same model, which they don't have, so next step is refund. They've fulfilled their obligation there.

You're not entitled to the newer model at the price of the older model, no, because technically it's a different product with different hardware. It's unfortunate, but they've not done anything wrong. Perhaps you can still get the older model elsewhere at the lower price.

You are whole though. Say you spent £100. You now have it back. So you aren't in any 'position'.
Had the same model been available you could have had a like for like replacement but I doubt a company is obliged to give you a different model.
I do understand it's annoying but I don't see that you are entitled to anything but a refund or like for like model.

Can you buy a second hand one from CEX or similar with the refund money?
