Child Maintenance Advice?

Mustbecrazyxx · 03/04/2024 09:13

My ex partner and myself separated nearly a year ago. In September we started a child maintenance arrangement as we disagreed on certain things such as; him believing the weekend he had our children he should pay less.

I did not know until we went this way that their calculations were based on the previous tax year, when I spoke to CM they said I could ask for a review/readjustment in April at the start of the new tax year as I know he is earning 90% more now.

Anyway my question is, if I ask for a readjustment/review will they tell him I have asked for it?

Also has anyone had experience with the ‘paying’ parent going self employed. Is it more difficult/confusing in terms of child maintenance?

Thanks!

Hi OP, I’m not sure if they would inform him at the point you ask for a review but obviously if the review leads to a change then he will know at that stage.

How do you know he is now earning 90% more?

The potential problem with self employed is that CMS can only take into account the figures HMRC have, and it’s incredibly difficult to dispute that. So it relies on him having been declaring everything properly and as it should be, it’s much easier to “fiddle” it when you’re self employed compared to when you are being paid for work as an employee.
