Confusing

Hi,

I hope you can help. My Aunt passed away just over a year ago the estate was just just over 2.3k in cash. However there is a house worth over 100k the house/deeds is still in her name. Probate has been granted finally which I have did myself. I have spoke to HMRC/DWP/Probate.

I get help with housing and so does my other family member but the one that lives there claims no benefits.

The house is accoupid by my family member who is also a beneficiary of the will. I am also aswell as my other family member is also.

It is basically 33% each of the estate.

The house is in disrepair it does need fixed we have come to the agreement it needs to be sold.

Have I done anything wrong?

Why do you think you've done something wrong? If the house has been left between three people then it's usual to have three quotes from estate agents and then decide what to do. If the person living there thinks they can get a mortgage on the place then they can buy out the other two. I'm not sure what the repercussions are for you if you get benefits. I'm sure others will be able to tell you.

I am the executor of the will, I have did probate by myself no solicitor, just paid the £230+ application fee. I have found out that even though I do not live there it may be classed as savings....which might land me and my niece in a very bad light...it's a very grey area. The house is there but I have nothing to do with it but I am also liable for 33% of it but it hasn't been sold.
