How long after I get an inheritance til I can get benefits again?

I got some inheritance few months ago but got scammed and was wondering when I’ll be able to get benefits again

Pip is not means tested, it is down to the individual disabilities you have. Uc is means tested so will depend on how much you have in savings.

If your disabilities are not compatible with employment you should qualify for pip but equally you can claim pip and work

If you had a lump sum and it is gone you will have to give intricate detail of where it has gone otherwise it is classed as deprivation of capital. They will literally want to see evidence of everything and all your bank statements etc. If it is felt that it's your fault the money is gone you will have a near impossible job claiming means tested benefits.

Note that any capital between 6k and 15,999k there is a tariff deduction of benefits.

If you no longer have the money that you inherited and need financial assistance then you should be able to reapply for universal credit. I think the threshold is not having more than £16,500 in savings. But you may not be on as much as you were before.

Why don't you ask them OP?
I think you can probably leave a message in your journal, and ask if they can advise?
I think it's usually above16k that they pay NIL,
When it drops below that they go through your finances and see how you've spent the money.

They're likely to want proof that you've been scammed, so you may need to show that you've tried to complain to the bank, and that you've reported it via action fraud...can you prove that you have no crypto?

They may deem you've disposed of the funds to continue getting UC which may mean months without any entitlement. But they may also think you're just really vulnerable and foolhardy with money, and allow you to receive the payments again because its a system that rewards financial stupidity.

I don't think it is clear whether op has ever received UC, ESA etc before the inheritance or perhaps was employed/self employed.

OP mumsnet is literally the last place you should be asking this question.
A lot of posters on here take anyone claiming benefits as a personal insult.
You need to contact the CAB. I'm sorry about what happened to you, but you need real life help. Good luck.

OP, have you got the police or any other agencies involved in the scam that robbed you of most of your inheritance? If not, I think you might have some difficulty convincing DWP that you haven't stashed it away in crypto or even given it to someone else to "look after".

The only way to find out is to start a UC claim and see what happens, tbh. But do get help from the CAB or similar advice agency. Deprivation of capital cases can be complex, but in my experience* the DWP are often pretty reasonable.

Reporting the scam will help to convince them that you have actually been scammed.

Not sue them, i was just making a complaint so I can go to the financial ombudsman who might make them do something. You have to make a complaint before going to them

It's not down to the bank. You won't get anywhere with that. Action Fraud if there has been a crime.

You seem like a very bitter sarcastic person. Sorry for your troubles. However whatever the relevant agency is called, I do know that acquiring the sum of £20,000 while on any of kind of benefits has be reported to them. I'm sure the OP knows which agency she is dealing with.

Perhaps you should get a person who you trust implicitly to manage your finances in future with Power of Attorney as you are vulnerable to fraud and theft.

Ok; During Covid 2020, my cousin inherited 60k after my Aunt/ her mum died. My cousin has MS and was at that time on full ESAand disability benefit as she is in a wheelchair. Her DH is her carer. My cousin told the DWP straight away, and they reduced her benefits to reflect the inheritance. Cousin and her husband spent £45k on getting disability alterations to their house and garden, and were told they could go back on partial benefits firstly when £16k was left, and again, would receive full benefits when they had under £6000 left. My cousin duly told the DWP when they had £15k left in November 2022. By March 2023, she had a little under £6k having bought a new front door, a new back gate and fence. The DWP made her submit all her bank statements from the time of the inheritance onward, until the point where she contacted them in 2022. They then did not return her to benefits, as they said, a decision maker had not conclusively, decided whether or not, there had been “deprivation of assets”on the inherited money. (for example, had she spent the money on a Caribbean holiday for several months, hidden some of the money, or had a blow out in Cartier one day) . She is still waiting to be returned to benefits as we speak. For 7 months she and her husband have been reliant on the food bank, and no heating, as the DWP are only just paying enough benefits to cover the mortgage. She has twice been told the DWP have “lost” the bank statements, and are still demanding statements up to the current date (December 2023). The DWP will not accept digital transfer of her statements, only photocopies, which, on 3 occasions she has now sent to the DWP via special delivery. Each time, the statements are shown to have been received, using Royal mail tracking, but the DWP deny they have received the statements, and said that my cousin must ask Royal Mail to deal with the issue as “it’s their fault”. My cousin calls the DWP every week, and is told “a decision maker will be in touch”. So now, after being completely honest with the DWP, 3 years after an inheritance, she and her husband are totally reliant on the food bank and family charity. My cousin is on anti anxiety meds, her husband has severe depression, they are struggling to live, just to exist. As a family, we are trying to help all we can, but times are hard for all of us …..They’ve contacted their MP, he told them he’d look into it, that was in April this year. This, it seems is what you get from the state after being honest with them. Whether OP has been scammed or otherwise, when you’ve had an inheritance of any kind, and receive benefits, you will be spanked VERY HARD. I’m convinced the DWP assume deprivation of asset in every case ! It doesn’t matter if you bought cryptocurrency and got scammed, or if you just lived a normal life, shopping at Asda, and being frugal….. the message here is……don’t expect your benefits back any time quickly. The State don’t care, if they did, there would be no homelessness, no poverty, no free school breakfast …but there is, isn’t there ?. I’ll leave you all to draw your own conclusions 😢😢😢😢😢

CAB is a good shout and you may be able to access some sort of emergency financial help or hardship fund ?

iIt will have to be investigated and proven that you weren’t deliberately depriving yourself of assets/ living beyond your means or hiding funds (for example colluding with a person known to you who can conceal your money under the pretence of being scammed).

I expect it will take a long time (months?) to reach a decision on your benefit entitlement.

You're wrong. When you have between £6000 and 16,000 your benefits are reduced on a sliding scale, if your savings are above 16,000 where they are reduced to nil.

Yes you're wrong, and the above ie between 6k and 16k benefits are reduced on sliding scale, whether single or in a couple, is correct. Reliable advice- citizen's advice or turn2us.

I understand ESA would have been stopped but PIP would not have been. It's not means tested or capital dependant.

How disastrous- the inheritance could have been life changing. I’m sorry you’ve been taken advantage of.

Some local authorities or charities provide an advocate for people under the mental health act or requiring help with decision making, navigating the benefits system, going to appointments, writing e mails filling out application forms etc.

You can ask the CAB about being given an advocate.
You can chat online to an advisor at the Citizens advice bureau if you can’t go in person.

They would still be able to get her PIP or DLA, husband can still claim carers allowance.
