My husband has just walked out on me and our 2 small children. the thing is, I am unemployed as I have been a SAHM. Will the morgage company allow me to take on the payments myself, and will I get any help paying it? The council say I can not get a house from them because I am not homeless. I just don't know what to do.

sorry not much advice but bumping for you. Have you rung the mortgage company ? Could you make the payments yourself ?

I don't know what the answer is either but wanted to bump it again, hopefully someone will know the answer to this.

Ringing the CAB would be a good idea, they will be able to give you an idea of what you will be able to claim. Sorry you are going through this.

get a solicitor
you may be able to get an order quickly forcing your husband to make the mortgage payments whilst everything is being sorted out

speak to your mortgage company straight away to ask for their help, eg freezing payments for a while.

The mortgage probably won't transfer the mortgage to you at the moment, because you don't have the ability to pay, and anyway your ex would need to consent to that.

Get a lawyer (if you're in Surrey I can give you a recommendation - not my firm) because all the financial matters need to be addressed as part of your consent order, which forms part of the divorce.

He is liable for the payments irrespective of whether he is living there or not, so he should still be paying the mortgage.

I am taking on my mortgage, but I earn about £80 a week and get tax credits, they were happy for me to take it on on this alone, with out even counting maintenence. My exH is signing it over to me ont he agreement that when I do sell he gets a fixed amount of cash.

With no job, it may be harder, council will need pushing if you give them a date you will become homeless and lay it on thick they may be more forthcoming.
