shouldnt it be their responsibilty to reimburse you rather than wait for the recipient to release the funds?

What are my legal rights?

This is a business account, btw.

you shouldn't have to wait. how odd. i used to work in banking.

They should reimburse you immediately. It is their mistake not yours.

I would be shouting very loudly.

I have been shouting very loudly, to very many people at the bank.

But they somehow say it is my fault. I had a standing order going out to that company, but it was cancelled in august. The fact that I used to send money, seems to count against me.

I used to work in banking too.

Your standing order was cancelled . They do not have your instruction to send the money so it's their mistake. Put a formal complaint in writing and give them 7 days to rectify - ask them to respond to your complaint in writing and if you're not happy take it to the ombudsman. How long has this been going on? - I seem to remember a post of yours about this before.

I'd wonder where the hell dh had been hiding nearly 10 grand!!!!

Hi,
My instruction was orally over telephone banking. The last such "Diary" payment went out in August last year. I have not posted about any such problems in the past, so I that must have been somebody else. Everything has been perfect till now. I started on 28th. I even noticed straight away and called them before lunchtime and they said they had recalled it and the money would be with me within the afternoon. Since then, numerous calls. But the other company is not authorizing the release of the money, so there we are. I am banging my head against the wall.

Wallofsilence, it is a business account. The payment went to a supplier we have used in the past.

Yes - I must be confused.

So you cancelled the payment in August? Was this a monthly payment? The fact that they haven't sent it since surely confirms that they received your cancellation request and therefore didn't have authority to send the money. They've recalled it fair enough but you shouldn't have to be outstanding. In fact if my memory serves me we (NatwWest)always refunded recalled standing orders immediately.

Definitely put in writing that you want the money repaying immediately. Get confirmation of any refusal in writing.
