Maternity allowance

Good Morning,

in a bit of a pickle and wondering if someone can help I’ve just received my maternity allowance reward for self employment which because of the benefit cap has left we £105pw worse off!

Everywhere I look online and contacting turn2us etc they are saying working tax credits would mean I’m exempt from the benefit cap….however maternity allowance is included in the benefit cap?

Which I think is absolutely disgusting! Can someone with any knowledge please advise as my 6 week holidays without paying childcare shoots up to £160 pw worse off? I’m freaking and hope this has been some sort of mistake!!?

8 years ago now but mw buggared up my Matb1 form and I got a lump sum very late paid... Council took the lot off my housing benefit... Always a catch ime.

I had maternity allowance in 2020 and it was a extra 10% deduction nowhere near this! And after some extensive research it says that working tax credits would make me exempt from the cap? I’m unsure if my local council have made a mistake here…..it does state clearly that working tax credits does that and dla is one of the few benefits that make it exempt.

So far as I can see from .gov WTC, even at a nil rate, exempts you from the cap.

As you're on legacy benefit and the Cap is applied via HB and HMRC are involved there's more scope for mix ups than an all DWP show in UC.

HAve you spoken to the Council and got their take?

Thanks both soo much I rang the council again this morning and they had it down as me still earning ONTOP of maternity allowance!!! Thank goddddd!!! It’s all been resolved! So basically they had it down I was earning wages aswell as my allowance!

The lady I spoke to this morning said she had no idea why who I spoke to yesterday didn’t notice!!!
