Child Disability element UC backdated, joint to single claim

Does anyone know if the child disability element will be backdated to award start date even if you’ve went from joint to single claim on UC?

Scottish child disability was applied for start of November. Parent had joint claim. Claim separated to single last month and now been awarded high care. So can they have child disability element back dated to November? As payment dates etc stayed same when joint to single claim went through.

Any advice would be appreciated.

Is the single claim a new UC claim, or the same claim but with the joint claimant removed?

If the former, it shouldn't be a problem. If the latter, I'm not sure how it works. I've managed to get arrears of SDP paid for a client in respect of a closed ESA claim, so the principle is established, but I've not yet come across that scenario in UC.

I'll try and remember to look it up next week, when I next crank up my work laptop.

Yes it same claim with joint person removed.

I spoke with universal credit yesterday, the gentleman I spoke to believes it should be backdated as joint to single claim is a change of circumstance. He said on their system they can see the claim being longer than just date of the joint to single split. He said to input the change of receiving the child’s disability, then request for it to be sent to decision marker. He advised to explain of the change of circumstances that happened whilst waiting for a decision on the child disability claim.

He said as long as it’s the main carer from joint claim requesting it and the amount would have been paid out after earnings etc was taken off the monthly statement from November until now.

So now it’s just a wait to see if they actually do backdate it.

I think it should be backdated, too!

Just a quick update the element is being backdated. Decision was made yesterday and today received notification of payment issued for later in the week.
