Can anyone help with a money claim we've submitted to a work associate of my husbands who owes just over £5k

We've given him lots of chances to pay, time and the option of a payment plan but after now ignoring us we took it to small claims

He has another 3 days to reply to the courts with his intention but we have received an email from him saying ' he will pay when he can, we just need to wait, he hopes to make first payment in may or June ' words to that affect
Very vague

But as he ignored all our other emails and option of payment plan I don't want to accede that email and then in a few months he ignores us again

Do we / can we reply to the email ? Or should we just enforce it in 3 days

Although he hasn't replied to the court letter as he should do he has replied to us

Tried calling the court helpline but they can't answer the question

Personally I would follow the process and if he hasn’t replied to the court by the deadline go to the next stage.

Keep going with the process. "When he can" is not a payment plan is it!

Once the court is involved he needs to engage with them, not you. The only reason to withdraw your claim is if he sends you all the money.

Keep going through the process. If he starts paying keep an accurate record of part payments and issue him a written receipt for what he has paid. He is trying to drag it out further but keep things formal.

When the court claim was sent to him then it should have included a 'response pack', one of the forms in the pack deals with this so I suggest you reply to the email to say that as he has offered to pay by instalments that he needs to complete form N9A (Admission) and set out what he is offering to pay per month and if he doesn't do so then you will be applying for Judgment and enforcing it.

Thanks all - this is what my gut was saying and I do think he's trying to stall as @SeasonFinale mentioned

I just wondered if I should do what @itscoldagainhere just so he is clear but I do agree that he has been sent the instructions

He has treated us very poorly before this so court really was the only option

Lesson learned
