Child maintenance 90%

Hello,

For a few months now my ex has only being paying between 90-95% of the monthly child maintenance amount. We pay through the CMS so I contacted then but they've said because he's paying at least 90% they can't do anything about it! Is this correct?

Sounds like he knows that the CMS won’t chase and he’s just being an arsehole.

So is this an a tual thing then that the CMS won't chase as long as he pays more than 90% ?? Sounds ludicrous to me

Get it in writing that he is paying 90% because they won’t chase him. It’s abusive behavior which is impacting his child(ren). I would be looking for him having supervised access only on a restricted basis.

CMS is absolute shite, I did not get one penny out of my ex for 15 years and they did bugger all about it.

Well I can’t get a penny and cms aren’t interested so sadly I can’t see the being that bothered if you are getting 90%

He can only be forced on to collect and pay when arrears have reached a certain amount. Can't see what that is but he must not have reached it yet.

Why punish this children? You can't withhold access for non payment, they are two different things

You aren’t withholding access. To not pay 100% of child support is financially abusive. If the father is being abusive then chances are they are also being abusive with the children. Manipulative behavior is abusive and I would call it out if you can.
