Parental loan

I'm currently going through a not v nice divorce. I'm living in the Family Home with our 2 children. Stbx has moved in with ow and doesn't see us at all. The old boiler has broken and I need £3k to replace it ASAP. Stbx won't help. We currently have no hot water or heating. My parents have offered to help me but stbx is trying to get me to sell up and wants 50% of the equity. Instead of my parents giving me the money for a new boiler could I ask them to "loan" me the money so I officially need to pay them back out of any equity on sale of house? This is so stbx will still be liable for his half. Could we write this agreement up ourselves using an online template or would i have to go to a solicitor? Sorry if not clear.

It’s worth paying a solicitor to get it right.

I understand why you want to do this but I think it will be a lot more complicated than you think (and therefore expensive). Do you have a mortgage? That might complicate things too if your parents loan is secured against the equity in the house.

I think that ex needs to realise that if he wants to sell the property that the buyer is going to want a safe and functional boiler.

Could you look to see if you qualify for a free boiler under any of the warm home schemes, if you are on benefits or tax credits you often can qualify.

You could be really obstinate and tell him that you’ll pay it (via the parental loan) and he can set up a payment plan for say a tenner a month for his £1500. Once that’s repaid, you’ll sell the house. I’m sure he’ll come up with the money a bit quicker then 😂 BTW, have you looked at glow worm boilers? They’re made by Worcester boilers and our plumber recommended them. Ours was about £700 cheaper and it’s excellent. It’s the boiler equivalent of getting a Skoda instead of a Volkswagen 😆
