Child maintenance

My ex partner of 21 years and the father of my 2 children doesn't pay child maintenance. He doesn't work so no income but has inherited 2.5 million pounds. Am I entitled to child maintenance on this basis?

It’s not a source of income for CMS, but you can apply for a variation order and they might award a notional income of a certain amount (used to be around 8% on 30k+) but a family lawyer could advise you how best to proceed now.

It might be worth asking a solicitor if you would be entitled to anything under section one of the Children’s Act.

I think there is case law for a similar situation.. a judge refused to believe that the Ex had no income whilst having assets.

I believe its "notional income" that assumes a certain rate of return on assets so that is classed as income.

A solicitor or CMS might be able to advise. Good luck - too many fathers try to not support their children
