Part Exchange/Stamp Duty Advice

Husband and I buying new build using part exchange scheme. Our current property is in my sole name, however wanted to buy exclusively in his to save on stamp duty as he is a first time buyer. The developer has said this isn't possible and we'd need to buy in both names, however didn't provide much in the way of reasoning. I feel they just wanted to avoid any complications and complete the reservation. Is this correct, due to legalities of the part exchange scheme or is it possible to buy in just his name?

I can understand why it may cause difficulties, the house you want to PX does not belong to the buyer of the newbuild.
I stand to be corrected but I can't see it working the way you want.

I thought couples were treated as 1 unit for stamp duty,are you sure your DH is entitled to the FTB discount

Hi, yes single unit whilst property owned. On disposal of residence, the first time buyer eligibility is reinstated. In this case our existing residence will be sold at the same time as purchasing the new one.
