Can anything be done, teen not being paid by employer

My DS has a job in hospitality, his workplace is owned by 2 joint owners. Last payday DS (as well as the other staff) has been paid 1/3 of his earning by boss 1. Boss 2 is meant to pay the remaining. Boss 2 won't pay anyone and makes excuses. Boss 1 says to staff to take it up with Acas which we will do. Can we get the money owed to DS? Any advice on what to do? Ds is owed over £200.

Number one: stop working there. Go and find another job that will pay him.

Has he got contact details for the other workers so they can approach this together.

He has refused to work anymore shift now. He's only 16 so it's his first job. He is already looking for another job.

He has some friends that also work there so they are all in same boat, most of the staff are 16/17 year olds, only a few are adults.

Report him to the local council. And to Revenue and Customs. Sounds like a planned scam to me.

Contact ACAS for help

tbey will give information on how to go about getting resolution

then how to take it further if still not paid

unfo some bosses state take it up with ACAS and when you do - they get surprised and think you won’t take it further, you can take it further and it’s free

He can claim unpaid wages from an employment tribunal but it will take a while and they have little powers to actually enforce. You can also report to HMRC for failure to pay min wage and they can enforce payment if they investigate and agree

Does he get paid through PAYE or is it cash in hand? If its the later, I would go in and firmly demand his wages and threaten to report him to HRMC if he doesn't cough up. My DH had to do this on behalf of our son when he had a Saturday job in a local takeaway at a similar age. They soon paid him what he was owed!

Hi, Can I ask what county you are in? Your son's situation sounds eerily similar to mine and was wondering if it may be the same company ( I know it is a long shot).
