Drink driving, what is the breath test results to pass?

Am trying to find out the test results after being breathilized (sp?) what is the allowed higest before being over the limit?

Legal limit 80mg of alcohol in 100ml of blood...I think.

Are you in UK? They should tell you there and then whether you were OK (green), borderline (orange) or red (fail). If you were (i think) orange you might get a caution and produce documents but if it was red they probably would have arrested you on the spot

It's not me, just found out from someone about my totally useless 23 yr old brother who is on total destrution mode, that he was stopped for drink driving

I want him to lose his license, he is totally on destrution & needs to be banned, he was 77.4 on the test i presume this is mighty high.

I don't know anything about them or how they work.

OK - take "you" as "him". If he was over the limit they'd have arrested him. They may even have done so if he was borderline.
The breath test works out how much alcohol is in the blood by how much is in the breath - that's why they make you do such a looooooong breath

(never been stopped for drink driving myself - I can't drive. I know people who have though)

Ah ok thanks, i heard from someone, have just told my mum she has hit the roof because he has been so out of control lately i think this is the last straw.

He has not told her yet but the person who told me thinks he was 2 times over the limit, i hope he gets a bloody long banned!

The legal alcohol limits are:

80 milligrams of alcohol per 100 millilitres in blood
35 micrograms of alcohol per 100 millilitres in breath
107 milligrams of alcohol per 100 millilitres in urine

So if he got 77.4 mg on a breath test then he would have been over the limit. That said he should have been taken to a police station and given the option of a urine or blood test.

I don't know what happened yet but am sure the story will unfold soon enough, i do howvever know he was stopped for drink driving & got a score of 77.4.

Nothing surprises us anymore, this has been a long time coming.

My mum went to go to work on saturday morning & found him slumped across the front 2 seats of his car out for the count with the car door half op[en

she woke him, he gace her abuse, swayed in the house & fell flat on his face in the hall way, where she left him!

He is a discrace.

Well, if he is convicted of drink driving then he will be banned and possibly fined too. The lengnth of the ban and the amount of the fine are usually dependant on how much 'over the limit' he was.

Well my mum has just found all the letter's in his draw, yes he was arrested on 25/01 he was over the limit & he has court on 14/02.

His result was actually 71.4 so well over the limit.

Long time coming this & i hope he gets banned!

If he was over the limit then he WILL get banned, and as my prev post said, possibly fined as well.

Thank you Karen, hopefully it will teach him a lesson, the longer the ban the better to be honest & a fine can just add to the state of his finances & debts to people.

Scooby, the guideline for 71.4 puts him into the bracket for a 20 month ban and a fine which would be dependant on his income. He's only just in that bracket, mind, as it's 71-85, but the bracket below (if they were feeling generous/he was very contrite is 16 months.

Def a ban.

He is double the breath limit.
He need not have been offered blood or urine unless he was unable to provide a breath sample.
He will be banned for at least 12 months but can be reduced by 1/4 if he pays for and completes an alcohol education program (if offered in your area) if this is his first offence
He will be fined, and ordered to pay court costs and a victim surcharge.
If his second offence or court feel reading high then they can consider other sentencing options. Take his licence to court-card and paper counterpart and see the duty solicitor

ah its 21 months reduced to 16 if he does a dirnk driver rehab to be compelteted 2 months before hte ned ofthe ban

the fine is 150% of a weekly salary plus 2/10

the lowest you cna ever get is 12 motnhds reduced to 9

PS re: the saturday morning scenario there is an offence of drunk in charge of motor vehicle-the car doesnt need to be moving for him to be guilty of this-esp if keys in ignition. There is a bit more too it than that, but he is at risk of being arrested again if he carries on like this...but sounds as if you know that already

He needs a bloody prison sentance to sort him, believe me anymore he does now is nothing more than he has already done, he needs to grow up.
