Yes it look like as you partner is on income based JSA you can claim, but is he definately on income based JSA rather than contributions based as people have not been able to make a claim for income based JSA for some years now, it is now Universal credit.

Yeah definitely income based, he is yet to get moved over to universal credit. I just couldn't see anywhere on the form or website about smp so was just checking. Thank you

ok surely your earnings would affect his income related ESA now if you are living together - you would need to make a joint claim for Universal credit if you've moved in together?

We moved in to temporary accommodation by the housing executive last week, we have a joint application with them. He has informed his jsa he is living with me but they didn't ask for anymore information just changed his address. Maybe because its emergency/temporary address im not sure. The girl at the housing executive did say when we get a permanent address we would probably need to apply for a joint claim on universal credit. Its all so confusing. I don't think my smp would affect his benefits much anyways

Yes when you get a permanent address you would need to apply for Universal credit for the rent element and also when your baby is born for the child element but I'm very surprised they haven't advised you to switch now as joint earnings would affect his income related ESA. I would speak to CAB or similar who will know their stuff.

The woman from his benefit office didn't seem to care just changed his details didn't ask what i was getting. I will ring them on Monday or universal credit and try get it cleared up so im not stressing about that
