HELP!!!!! Anybody know anything about legal procedures in local authority tendering?

My dd goes to an absolutely superb local authority nursery in Lambeth. Lambeth are trying to transfer all their nurseries to private hands because apparently they don't have enough money to run them (but they've got a spare £300K for the bandstand in Clapham Commom). The parents group have been trying to fight this from the start.

Earlier this week we were given the name of the 1 company on the tender list. This company is formed of staff who were working for Lambeth (working with the Early Years development programme) at the time of process being started. Is this allowed? She obviously has a lot of inside knowledge. Does anybody know if we have a legal case to challenge the tender?

When the public were initially invited to 'Express an interest' the nursery manager was told that if she wanted to apply she would have to resign immediatly.

Any advice would be really appreciated. There are so few non-private nurseries about. I really want to fight to save this one.
