hi all can anyone help???
my ex took me to court for this order and has not seen my son for the last 5 years. can anyone tell me if i can have this took from him? he has never sent a birthday/christmas card or paid any maintanance for him or even contacted us for well over 5 years my son is nearly 8 and he wants to take my surname and can't due to this. nobody has a contact address or number for him.
what do i do...can't afford solisitors as they cost too much and i dont have the money for it.
im not on benefits.
advice anyone........

tbh PR doesnt affect much. it will just give your ex the right to be involved with schooling, religion, medical treatment. depending on how much you're earning you may be able to get half an hour to see a solicitor under legal aid as far as i know. usually they give fathers PR anyway, but under certain circumstances they dont. if he hasnt seen ds in 5 years then he should have less chance to get it as he hasnt had contact or support him

thank you very much, i was not married to son's father but i am married now, i just want my son to be happy and he keeps telling me to give him the same name as the rest but due to this order i can't i will contact a solisitor monday and fingers crossed i get PR took away from him. i fought like mad to not let him have it as he was taking drugs to my knolege and didnt feel he was able to care for him, but the judge gave him it with out even really listening to my concerns...i knew he wouldnt keep it up...pitty its the child who ends up suffering

I don't really kow about PR,luckily my ex hasn't bothered getting it, but surely your son can call himself whatever he wants? Does it have to be official? Can't he just tell people that's what his name is, get the school to change it on their records etc?

he is 'known as' in school but doctors and things like that call his name and he grumps...just tryign to do what he is asking of me and find a way of doing it all legally...such fun

I'm so glad now that I insisted bean had my name on his birth certificate, it didn't seem like a big deal at the time but i didn't realise what problems dads can cause.
