HMRC maternity pay dispute

Hi!
How long will it take HMRC to sort a maternity pay dispute with my boss? He's just refusing to pay me and I'm having to go through HMRC. How long will it take roughly to get my money?

@slyfire what do you mean he’s refusing to pay you. Are you eligible for it? If so, contact Acas ASAP

@OCM19 yeah I'm eligible, i tick every single box! I went through citizens advice and they advised me to go straight through HMRC. Is ACAS an option too?

This is on line. If you are entitled to statutory maternity pay your employer must pay you. If they don't HMRC will pay you and fine them. Only they will know how long it takes. Every case might be different.

Acas will look at this from a potential discrimination aspect. HMRC will be for the actual payments, but if you’re entitled and you’re not being paid, it may suggest unlawful discrimination. Did he give a reason? I’m sorry you’re going through this

@OCM19 I might go through both them, his reasoning was 'I don't know how to do it I need to figure it out' I even said about the SMP1 form and when I actually looked at it he couldn't do that either because I meet all of the maternity pay criteria. I've had nothing since he said that :( I've been threatening with contacting HMRC for the past two weeks and he still hasn't bothered to do anything and just ignores my messages, so I think that's what I'll do first thing Monday! Thank you for your help x

@Viviennemary ah perfect thank you! It's gotten to the point now where it's the only thing left I can do! It's a shame but hopefully they'll sort it out for me x

Does he run the payroll himself? Not that you should have to but tell him to use HMRC Basic Tools, he just has to fill in some boxes and it tells him exactly what to pay you.

@Hellocatshome he uses his cousin who's an accountant to pay us all through PAYE, I sent him the HMRC basic tools link when he first shrugged me off and I even offered to go through it with him. He just can't be bothered and I don't think he realises the consequences it could lead to. you'd think someone who claims to have been running his own business for 20 years would have a clue on how to pay people :( x

HMRC first thing Monday. Sorry I can’t advise how long they will take.

If you are left with no income also contact DWP for any benefits you may be eligible for.

Can I repeat the point that this is maternity discrimination also. And in a fairly cut and dried way. I would definitely also ring ACAS.

Did you give him your MAT B1 form?

Has he then given you an SMP1 form?
