Fraud CCJ

Hi all,

After some advice if possible! We moved out of a rented flat in September 2018 and bought a house - Christmas December 2018 I noticed a search on my credit file for Very for the flat address. Called them to query it and someone had tried to buy a mountain bike in my name.

Fast forward to this week and my husband has been notified of a change to his credit report via email - a CCJ. He’s rang the court to be told it was registered by Talk Talk in 2019. We were with BT and all utilities were in my name when we were living there so the new tenant has called to set up an account in my husbands name.

He’s not passing security as the DOB and contact details are incorrect.

How do we go about getting this removed? The court said there’s a £250 fee to have it removed, but surely this is mad when it isn’t his debt, we haven’t been notified as the contact details are completely incorrect.

Any help would be appreciated

There is a Live Chat on the Talk Talk website, available during their opening hours. I would get him to use that

The difficulty is that once you tell the provider you arent the account holder they can’t discuss the account with you. Also some take the attitude that since it’s not you who has been defrauded you can’t take action.
Try Action Fraud

If you're on a low income or benefits you can apply for help with the Court Fees.

It’s utter madness there are court fees when he’s a victim in the whole thing.

Well yes I do agree. You can talk to the Police and get them to investigate it as fraud, then write to the Creditor and get them to set the CCJ aside so that you don't pay.

Going to ring action fraud tomorrow, just grateful it hasn’t come at a time when we were looking to remortgage or anything
