Bl**dy Orange Phones - help please...

I have a 'phone and a contract with Orange. I always get a bottom of the range 'phone as not into geeky stuff. Had to take the battery out last week - first time - the very, very tiny hook holding the battery cover in broke. Spoke to Orange who said I have no insurance (true) and so they cannot replace. My view is that my 'phone should be 'fit for purpose' and that the battery cover should not break the firs time it is removed. I still have 11 months to run on my contract and a broken phone - any ideas? Can any legal people tell me if my argument is right?

would imagine it depends if it is still under guarantee or not

how old is the phone? where did you buy it from?

Bought the phone from Orange 6-7 months ago. Just spoke to Ofcom - they think that I am correct and that Orange should replace the 'phone. I've been with Orange for about 10 years, can't believe how difficult they are being about this.

A quick call to Orange explaining that you have only had the phone a short while and the fact that you have spoken to Ofcom should hopefully do the trick.....failing which tell them that you will be cancelling the contract as soon as your current one ends!!

I'm waiting for one of the supervisors to call me back (hmm - bet they don't). Ofcom have advised me to make a formal complaint if no replacement phone provided and to ask for a 'final position' response from Orange that I can take to the Ombudsman. Ofcom were really, really helpful - if anyone has problems in the future with Orange or other mobile providers do call them.
