If i get my name taken of the mortgage will i be entitled to any of the equity when the house sells or not? Will i have to reply on ex dp's good nature instead ( hope not as he doesn't have any!!)

I am sorting this out just now, but putting it in my name.

went to mortgage person at bank where I have mortgage. They checked if I was able to pay the mortgage myself before agreeing to sign it over to me, draught documentaion printed off which I have to take to solicitior to get it "done officially" which will be done as part of the solicitior sorting out our seperation.

The equity part of it seems to be more the concern of the solicitor not the mortgage people as the amount will be part of the seperation agreement.

You can ask to have the house valued and request 50% of the equity. There may be other factors that would mean the amount could be less or more such as pensions and other agreements on items of value like cars I suppose. YOu could ask for the money now or agree to wait until the house is sold either now or in the future.

What ever you end up doing I wouldn't agree to relying on goodwill, things may change. Get it down on paper now with the help of a solicitor.
