My ex husband has a charge on my house after we divorced 8 years ago...I'm about to sell the property and buy a smaller one..Does anyone know if we both have to pay towards the conveyancing costs and estate agent fees for the selling of the family home or is it all down to me....in packing up the house i've mislaid all the paper work.

I would have thought all selling costs should be paid from the sale proceeds.

Unfortunately I would expect it to entirely depend on what that paperwork that you cannot find says.

I would guess that the fees would be deducted from the selling price of the house. And then the charge applied afterwards. But all depends on the terms and conditions.
