Help with a transfer of mortgage and current mortgage DD payment date?

So in my divorce settlement I’m taking over the mortgage in my sole name.

Our current mortgage payments are made on the 5th of each month.
Currently my ex lives in the house and the court order states he must be out on the 3rd March and my mortgage will begin then.

He pays the mortgage whilst he currently resides there alone. What will happen with that last Direct debit that is meant to come out in the 5th of March if the mortgage is transferred on the 3rd. I don’t want to end up paying for him to live in the house for almost a month.

I hope this makes sense.

I would imagine it's like when you move. The mortgage is calculated up to the day it transfers over. So his payment will be reduced by 2 days and he'll pay until the 3rd. Then you take over.

Ok the last DD will still come out of his account on the 5th but will be slightly less?

No....when you change a mortgage, and I'm not an expert, but the whole thing is paid off and a new mortgage starts. So you would pay in March 5th. It is no longer his mortgage. He would settle up on 3rd March - from then on he has no liability for your mortgage.

This should all be on the paperwork. Surely you have solicitor dealing with the transfer of deeds. They can advise better.

You may find the new payment isnt set up in time, and you pay nothing in March, and double on 5th April.

No, I think you pay your mortgage in advance. But sometimes miss the first month/first few days and make up for it when you do actually pay (so if it becomes yours on 3 March, you will probably pay for 3 March - 30 April on 5 April.
