pnc given even though i had a pay & display ticket..........

Hi there i know im goingt o fight this all the way just was hoping for some helpfull advice to help me along.

1st august took dcs to chemlsford parked in car park paid for a ticket stuck it on drivers window. Went off done shopping etc and came back to find a penaly ticket on windscreen.

Ticket said i didnt have a ticket saying i had paid to park there. Fair enough you had to move a piece of willow tree out the way to fully see drivers window. But ticket was definately there and was over hour left to go on what i paid.

I took photo to prove it but prob is camera phone now broke so not sure can be recovered.

I did keep the ticket and photocopied it and sent off to chelmsford explaining i did have ticket and penalty was issued falsely. They replied yesterday saying they are satsified it was issued correctly and enclosed is the photographic evidence to prove it. There were 2 photo copies of a photo first was of my windows at rear of car 2nd the " proof" was of only half my drivers side window. Conveniently avoiding the actual p&d ticket.

Im going to fight this as i know i brought a ticket and i know i displayed it.

Im just fuming at them but they seem to be hell bent on me paying!

Hi there - yes, fight it all the way. Firstly, this is not proof that you did not pay (the pictures that they sent you) this is only proof that it is your car!!

you purchased the ticket and that is proof enough.....they will have a time when the photos were taken and there will be a time on your ticket......fight it all the way.

You did not break the law.

Try and get your phone fixed if you can to retrieve the picture but the ticket will have a code on it saying what machine it came from. Keep fighting!!

thanks guys i have a photocopy of the ticket itself and the original ticket somewhere to. Just wish it was one of the new machines that you need to put your reg in. But i will fight and i will show them up too!

You know even if worst came to worst and you ended up being taken to court, the onus is on the prosecution to prove BEYOND REASONABLE DOUBT that you have committed an offence.....they cannot do this in this case so you go girl and do it not only for yourself but also for others who this might happen to.....I know from experience.....my sister once got stopped for going through a red light....she said she did not do this and because it was her word against the police officers (there was only one) the matter was not taken any further.

I wrote a letter to our council once as my Dad was given a ticket for parking on a double yellow line even though he'd displayed his Blue Badge - he's walking impaired. I sent a copy of his Badge, protesting about this and the ticket was cancelled. Dad was all set to pay it!

Tbh i think they get away with it because people do just pay, rather than risk the higher charges. It was a scabby carpark for max 15 cars but i did pay. I doubt they will take me to court because they know they are wrong! But if it does im all for it

I find this rather telling... you need that photo from your phone (which hopefully will show that it is placed somewhere not in their photo.

thing is dh did take ticket off to look to see if we had gone over our time then stuck it back on to take a pic whilst i was reading the pnc. Having spoken to them they have said they took 6 pics and 1 is a full on one of my window which i said send me acopy then! As i know its a lie because the ticket was stuck on the window i will swear in court to it. I will keep updated as to whether i go to court or they drop it.

If they took 6 photos then they should have provided you with these...interesting....I wonder why they have not??

I dont think they took 6. I think they know they are wrong but dont like being challenged. They have quotas to meet dont they!
