Maternity KIT day query

Currently discussing this with HR but wanted to double check here so I don't make a fool of myself if I've misunderstood.

Contracted hours are 42 per week gross (with meal breaks), 37 hours net.
Payment for KIT day is by hourly rate for hours worked that day. Calculation from HR is annual salary/52 weeks/42 hours*hours worked - 1/7 stat mat.

This calculation has just been sent to me by HR on request so it seems I should be filling in my KIT day claim form as 8.5 hours worked to include meal breaks?

There was no documentation to suggest this so I have submitted the form as net hours worked (7.5 per day).

So for example a 35000 salary working a 7.5 hour day (not including meal break of 1 hour) 35000/52/42*7.5-21.42 = £98.95 per day

Including the meal break is an 8.5 hour day so 35000/52/42*8.5-21.42 = £114.97 per day

Which one is correct considering the revelation of the formula used to calculate hourly salary?
