Hi Everyone - after some advice. Split with my ex wife 4 years ago and divorced 2 years ago. Court said house to be sold 80% in her favour. House has been on the market for 2 years with 1 offer which she rejected. I still pay the mortgage and rent a room from a friend. I have less than 150 a month after bills. She will not negotiate on sale price and going back to court for the 3rd time. Courts seem reluctant to do anything because she has the children. I cant cope with 2 more years of this. Has anyone been in a similar position? As a result of this my health is suffering. BTW she asked me to leave 4 years ago.

I'm not sure that would be the best for the children. I cannot understand why the court system makes it so one sided that people are getting destroyed

I’ve seen one such situation. Psycho of a woman was very obrstructive and the gorgeous desirable house sat on the market for years as she blocked sales.

I agree that she might feel more motivated to sell if you’re living there again.

I hope someone with the understanding of legalities comes on soon.

Shouldn't she be paying towards the mortgage?
Not sure but isn't she liable for half if joint mortgage?

she should be but refuses to. unfortunately I have to keep a good credit record or I can lose my job. I have offered her the whole house but she is not willing to get a mortgage in her name. I just want a fresh start but she has made it clear she will be applying to extend spousal maint after the 6 year period the judge set. seriously considering bankruptcy to force the issue

I don’t actually have a clue, but what would happen if you just stopped paying the mortgage? Would the house be repossessed and sold off? Or are you desperate not to ruin your credit rating?

I have spent all the money I have on solicitors. If I don't pay the mortgage I would lose my job as work for a bank. I don't know how many years a judge would say is reasonable to sell a house. I had to take her back to court last time just to get it revalued. She has no intention of selling and each time it is myself having to pay to go to court
