Just go straight to the small claims court, going through the ombudsman is playing straight into their hands.
Quick results from going straight to court.

hoolagirl - Why is going to the ombudsman playing straight into their hands? I was going to go down that route, but I don't know whether to now. If you don't get any joy from the ombudsman can you still take it to court after?

Don't think ombudsman get involved with these as bank did provide with t & c's when a/c opened, what you are now doing is saying you believe the t & c's are unfair and charges basically theft / illegal: it's more a legal point and ombudsman can refuse to take up cases if they're not appropraite, although if you do go through ombudsman and they don't rule in your favour i'm sure you can still then go through small claims.

My mum is getting nowhere fast with her bank(Abbey) and has recently contacted the Ombudsman who are taking it over for her.Hopefully she'll finally get her charges back from the bank soon.
