Removing my name from mortgage?

Due to separation/impending divorce, I need to remove my name from our joint mortgage (he is able to afford the mortgage on this own salary).

How complicated is this process? How long will it take?

I think he needs to "remortgage" without my name on it? And if he can't get the mortgage he will have to sell the house instead?

Any advice would be great. Our solicitors will help sort this out but I'm still waiting to hear if I'm eligible for legal aid so my solicitor won't do the work yet.

It will be up to your lender to decide whether they want to let your name come off the mortgage. They might, or they might not, depending on whether H can afford it on his own. He wouldn't have to remortgage necessarily. Is he going to pay you off with regard to your interest in the house?
