I'm just looking for some advise on the following situation:

I'm currently on maternity leave (have a 12 week old ) and my work have sent me an email said they have to deduct £400 from my next pay as they have received a letter from the court telling them they have to do it as I have been fined.

I had no idea what this was about so have rang the court who told me I was prosecuted last July by DVLA due to a car not meeting insurance requirements. Apparently all letters went to an old address that I haven't lived at for over 2 years even though I updated my driving licence ect..

The car in question is one I had whilst I was a learner and was always insured until I had it sold for scrap - I cancelled insurance when I had the certificate of destruction. The court couldn't give me any more information than it didn't meet insurance requirements so Im not entirely sure of the issue.

I'm not sure if there is anything I can do at this stage my work said they have to take the money or they can be fined and the court said ive already been prosecuted so don't know who I can argue with that I don't believe I did anything wrong and I never received a letter in the first place about the issue.

I only get approx £600 maternity pay so I have no idea how I'm supposed to pay everything next month if they take £400.

Has anyone had a similar experience is there anything I can do?

I would talk to Citizen's Advice very quickly!

Thank you. I have spoken to HMRC again they said it can't be taken from SMP so just waiting to speak to my work now.... hopefully it should go on hold till I'm back at work which gives me time to find out how to dispute it!
