Applied for financial order for me and my children and now ex refusing to pay child support!

Me and my children are in a refuge because of my husbands financial, psychological and emotional abuse towards me.

I have applied for a financial order for me and the children which can take 6-12 months even longer if he protests against allegations of abuse.

Me and the children are struggling financially and he is holding all the cards and refuses to pay any child maintence in the mean time until a court orders him to do so.

Is there anything I can do? Whilst waiting for a heering can’t. I apply with child maintenece options? I would wait but he has left us homeless no furniture as he refuses to give me it back, he has sold my car. Sold his car, sold his trucks, hidden money, put one of his businesses in his mums name all so I have nothing. He wants to see me in the gutter begging for his money.

Please advise if I can apply for child maintence in the meantime? Or does he have the right to not pay at all until a court orders him to??

You can ring the CMS immediately and start a case for maintenance. It will cost you £20 and you will have to give some basic information if you have it about his address etc. They will write to him and he will have to reply and they will tell him what amount of maintenance you are entitled to. If he does not comply they have the authority to remove it from his wages. You do not have to wait for this to go to court. Its a simple phone call to get the ball rolling.

remind him that CMS now use the VAT paid in his name as proof of his income, not just whar he decides to declare

definitely go through CMS and check you’re getting the benefits you’re entitled to
