Probate - urgent assistance needed

Any help gratefully received: My Dad died suddenly leaving debts in his name of around £25, 000. His assets will in no way cover that amount. We are worried that my Mum will have to sell the house she shared with my Dad for over 30 years to pay off his debts. Is Mum liable, even though the debts are all in my Dad's name? Thanks.

Hi chip butty...............I am a probate solicitor.

It is very unlikely that your Mum will have to sell the house but sometimes you have to be pretty robust with the people who your dad owed money too as they will sniff around and be very keen to try and recover the debts.

Did he have any sort of insurance attached to credit cards and loans etc ?

think they could force a house sale if this is all the capital available - could your mum reach any form of agreement with them?
