f**King Tax credits.....we are being charged £7000 now we have split and dh cant afford the repayments

Have split with dh and now living alone with the kids, he is buying his mums house and living with her. As if that werent bad enough, the f**king tax credit people overpaid us years ago and told us we could repay over the next few years which we have been doing and all was fine.

Now i am having to make a new claim as a single parent so they want the 7 grand back from the last claim. Even spread over 2 years theres no way dh can afford it.....he already has 2 mortgages to pay and lots of loans....i think he is going to kill himself or do something stupid cos they are chasing him for the money...
What do we do?

Well first things first. You ring them and tell them you cannot afford to fork out £7k just like that.

There must be a way round it. Surely they can't expect you to pay out in full.
I dont know anyone who could do that!

i have rung them, they said he has to pay it over a 12 month period which equates to nearly £600 a month: theres no way he can afford that on top of paying 2 mortgages and 2 big loans. they wont suggest anything else other than the 12month payments.

If you could afford an extra £600/month, why the fuck would you need to be claiming tax credits in the first place?

Been there!

Contact citizens advice asap. They will be able to help with this. If they cant do it directly then they will be able to give you the number of someone who can. There is a way around this, do not despair.

Email Tax office complaints to
[email protected]

They will look into your case and get in touch usually within a week, they contact the IR on your behalf.

Get him down to the CAB, they will sort it all out.

I think if you make a formal (i.e. letter - registered post, and keep a copy) offer of anything a month (it could be a £1 a week, but better to be as much as you could afford really to bring the debt down) if they decline it and you end up in court, it will be thrown out once the judge knows you made a reasonable offer that was rejected.

thanks for your messages....i am just worried he will do something stupid from the worry of it all...he has already taken the split very badly and has now become a recluse. i am ringing tax credit line now to see if they could spread it over 3 years but even then it will be too much. God i hate them hate them hate them hate them!!!!!!!!!!!!!!!!!!

Can I ask why he is paying 2 mortgages? Surely he doesn't have to buy his mother's house if his finances won't stand it.

His bloody mother's house is about to be repossessed (as she is shit with money)and he has stepped in to pay half . she is so utterly useless and dependant on him. this is why we have split.
