Selling home fees advice needed

Hi, so our house was up for sale about 5 years ago with a local estate agents. The house never sold and we didnt want to lower the price anymore than we had already done. We kept it on the market and started redecorating a bit to see if that would help as we weren't desperate to move. After a couple of months the estate agent took the huff and stopped advertising the house leaving a voicemail saying they wanted us to pay the fee in the contract for taking a house off the market. We never paid the fee because we didnt ask them to take it off the market, all we had done was refuse to come in and discuss changing the price. So anyway, 5 years on and we have completely modernised the house and another same sized house in our row recently sold for a good price. We want to sell and will obviously use a different agent. My husband mentioned though that he is worried the first estate agent can somehow take a fee if we sell because we never officially took it off the market / signed a contract to end the contract with them. They haven't advertised it in 5 years though so surely they can't take any fee?

I think most estate agent's terms and conditions state that they take it on for a set amount of time. Could you possibly call pretending to be someone else and ask what length of time would you be tied in for if you were to go with them etc.
