Advice on DH Pat leave

DH has come home today and been told by his boss that he needs to book Pat leave soon, and has been told that if others book time off, when baby arrives (if its not the dates his booked), he cant have it!!!
Im so mad, babies arent buses that you run a timetable for. DD1 was early, and we were in for a week after. I dont need him at home when im in hospital, or when the baby is 4 weeks old!
Can they do this?

Thanks, hope it all made sense! I wouldnt mind but he get SPP from them, so cost them nothing.

i think they'll find that he can't legally take it til the day the baby is born anyway

Agree with bEllieK-Spp can't start til the baby is born,so there has to be some flexibility from your Dh's employer.
My Dh has just filled in the relevant forms,stating the babys due date and where it asks "when would you like your leave to start" he has put "when my wife goes into labour/baby is born".
