Stamp duty

My husband is in the process of buying a new house in his name only as I have a house already. We will live there and rent mine out. The problem we have is the mortgage guy has told us he has to pay the higher rate of stamp duty as still on his ex wife mortgage, she has changed the title deeds to her only so really he's only a guarantor as the mortgage company wouldn't release him. Does anyone know if this is correct as the property is now hers as shown on the title deeds 😩

As you're married he'll have to pay the higher rate of stamp duty, regardless of the situation with the ex-wife.
