advice please

Hi

mine and dp's relationship is very rocky at the moment, we live in a rented 3 bed house. There is me dp and dd.

What i would like to know is if me and dp split up, i am a sahm so would i get the rent paid for me or would the council make me move into a smaller house.

We rent this house from a friend of mine and get the rent about £100 a month cheaper than a 2 bed house.

Any help appreciated.

yes i think if you go on benefits you will get up to about £70 - £80 a week help towards your rent, hope this helps x

Thanks, what i really want to know is will they make me move out of my 3 bed house into a 2 bed house, even tho my rent is cheaper in my 3 bed than a 2 bed would be???

No, i very very much doubt it, they have enough people looking for homes without making more for themselves, its not up to the council anyway, its the benefits agency that will pay your rent x

Actually housing benefit is administered by the local authority.

No they wouldnt, If it was very expensive they may may you contribute towards it, but as it isnt, no.

In the private sector, you get paid the amount of benefit for the rooms you need, so you would get the same ben for a 2bed or 3 bed, ie same amount as you dont need 3 beds.

As for council, i really dont know if they would say youhave to move. There are alot of people on the list for 3 bed homes, and my only guess is that if someone at housing bens sees you have a 3 bed, maybe they have to inform the council about underoccupancy??

Also if it is council and you are renting from a friend, surely this is subletting on your friend's aprt and this isnt allowed and could get you in to bother , or them, if you claim bens for a home that's not officially your tenancy??

The house is not a council house, it is my friends house, the he bought and rents out to me and dp.

I know there are alot of ppl on housing list for a 3 bed property but my friend would not let it out for council or ha use.

If i could not live here he would rent it out thro a agent.

I see, ok, then you will get housing ben for atwo bed even its a 3 cos its as they say underoccupied, this happened to me when i had to take new accomadation temporarily when dh left.
