Are you in Scotland, or England and Wales?

England.

A smack would be illegal if the person was not the parent or guardian.

A parent or guardian may smack a child as a form of punishment (but smacking without a reason would be assualt). However a smack given as a punsihment could be seen to be an assault if it leaves a mark (eg scratch or bruise).
