Bank Charges - Advice Please?

Hi I'm posting this separately as the other thread is so long!

Here's the story so far...

Early June - wrote asking for a list of charges. Heard nothing.

Mid July - phoned and paid the fee. Copy statements sent for some of the period.

Late July - requested missing statements by phone. Nothing more received. We are still missing about 3 years worth.

August - wrote asking for a refund of charges for the statements we had and for the missing statements.

October - received a letter from the bank offering to refund some of the charges. Wrote back stating until we'd received all statements we were not in a position to accept their offer.

November - letter from bank saying that they noted we had refused their offer and that they would not be refunding all the charges. Phoned asking if they were refusing to supply the missing statements. Of course they are now sending them

What should my next step be? Is it worth going back to them once I've received the rest of the statements? Or am I looking at the Ombudsman now? The amount they offered was a significant amount but I don't think I should be accepting it until I can see the full picture.

Also can they withdraw their initial offer now?

As far as I am aware you are perfectly within your rights to refuse any offer other than the full amount - they do have the right to retract their offer though.

I would say go back to the second stage when you have the full amount of figures - the "I see you owe me x amount, I want it back" letter, and see what happens from there.

That was my inclination flamesparrow. Their letter says more or less "you've refused our offer but be under no illusion we shan't be refunding it all".

We'll see if and when I get the rest of the statements

i posted on the bank charges thread too, i wrote to looyds tsb asking for my charges back.
they replied after 2 days saying they were looking into it.
well today i received a letter say they are not paying my charges back, because after investigation into my account, they have concluded that the charges were justified as i didnt maintain my account well! wth!, i only paid charges this year, up till then id had my account for nearly 20 years and never gone overdrawn..the b*(&^^s!, they said, they look at every case on its own individual merit but that i didnt warrant a refund, then they had the cheek to suggest i go to the banking ombudsman if i wasnt happy..so what now, do i send the letter threatening court action?
