Concentrix - Complaint & Compensation.

Concentrix wrote to tell me they had "evidence" there may be a partner living with me. (There most definitely is not)
I rang them immediately. Their computer system was down. I asked what the evidence was and they said "Under the D.P.A. (Data Protection Act) we cannot tell you." I asked if I had any rights under the F.O.I. (Freedom of Information Act) to find out what this so-called "evidence" might be, so that I could refute it. They told me I did not.

They then said the only thing I could do was send them original copies of Bank Statements, Benefits, Mortgage or Rental Agreements, Household bills, Legal docs pertaining to my marital status, Council Bills from April 2014 to Jan 2015. I said I was not happy about doing this because of the inconvenience, postal expense and my concerns in case the documents were misplaced. They told me if I did not comply "we will stop your tax credits". (not we may not be able to make a decision accurately and it might affect your credits, but we WILL).

Now, I suffer from acute clinical depression (which I try hard to fight) and also vertigo (which leaves me exhausted sometimes) and Chronic Fatigue Symptoms, so I work from home and do the best I can to do as much work as I can, but I am limited. I felt I was being unreasonably threatened on unfair grounds and unsound "evidence", so I complained and asked for my case to be escalated to speak to a Manager which they duly did and we basically went round in circles getting nowhere and just repeating the same information so I asked them to please make a note that I was unhappy and wanted to complain and to enter that on the system when it was working again.

I was obviously stressed and worried so I spent most of that night fretting and looking up the internet. Thankfully a friend suggested Mumsnet and that was very helpful - so I am returning to add my story and possibly provide some more helpful advice.

I picked up some useful information;
The Information Commissioner's office ico.org.uk/
was helpful and had instructions and a template for a complaint letter where you can add your own details. ico.org.uk/for-the-public/raising-concerns/

I also checked the Data Protection act and found I have rights to ensure information is accurate and up to date. (which clearly it is not)
I also have rights to know (roughly) certain details about the information held about me and how it is being processed. (sections 7)
www.legislation.gov.uk/ukpga/1998/29/section/7

There is also a Government Charter tinyurl.com/qyyhmj2
Which says they will "help and support me to put things right"
"Do all we can to keep the costs of dealing with us as low as possible"
"put mistakes right as soon as we can"
(etc.)

Having had no joy with Concentrix, I checked the paperwork and found a number for HMRC and rang them directly. Again didn't get much joy, so asked to speak to a Manager who said he couldn't do much about an external organisation, but would put me onto Complaints dept, who duly discussed my issues and concerns and raised a complaint and said he would ring back to update me.

I then rang Concentrix for the second time and this time their computer was working. The chap was perfectly nice and polite, apologised and discussed things sensibly, but, again, could not and would not share any information. Though he did explain it may be that a previous resident still had accounts registered with this address. I knew the name, because I had been returning any mail to sender and the Housing Association were able to confirm this name but Concentrix operator said he was not even allowed to confirm or deny this.
I felt that one simple document could end this grief, my rental agreement with the housing association, but it seems I am still obliged to send off ALL these ORIGINAL documents, which obviously I need to copy just in case they misplace them or go missing in the post.

Today HMRC Complaints dept. rang back, apologised Concentrix had not responded and offered me compensation for the distress (£40) and expense of phone calls (£10) if I agreed to close the complaint. I explained it was not about the money, but the principle of the thing if, according to Mumsnet (etc.) there were other people being distressed by this ridiculous process and some frantic with worry. (as detailed in this very forum)
Coincidentally Concentrix e-mail to him arrived during our chat. They said they had spoken with me, we had come to an agreement that I would send documents and I had not made any reference to a complaint with them. (wrong!)

Just after that Concentrix rang and it was their complaints department now, so I listed 7 reasons I was unhappy and the nice man took notes. He said he had also listened to the recordings of my previous calls to them. He was very nice and apologised and seemed to understand my issues entirely and was kind and helpful. He also promised to ring back - and said there might possibly be compensation involved. Again I said it was not about money - though this will cause me a loss of time and some expense, but the principle of sending out letters accusing people of fraud and threatening taking away benefits to which they are entitled.

Furthermore, I don't feel any of the paperwork they have requested would ultimately prove beyond any shadow of a doubt that I have no partner living with me. For example, several years ago I had a good friend down on his luck so I let him stay with me for about 5 months till he got sorted out. I was employed and had my own house, so it was nobody's business (at that time) but in no way would my bank statements or bills reflect any difference whatsoever that would indicate someone was or was not living with me.

It is not over yet - I AM still obliged to send the paperwork. I am still not happy and ultimately I still have to wait for them to make a decision, so I am left worrying over them taking away a part of the income I depend upon.
Nevertheless, I figured if I shared this information perhaps if more of us complain they might change their procedures to something more reasonable and stop frightening people. Perhaps they might even change the wording of their standard letter and the way they respond to telephone callers trying to sort things out.
The crazy thing is I keep 100% honest records and if they had simply said "Mr B, we are carrying out random checks and it would help if you could provide information" I would have complied - not happily, but I have nothing to hide.
I do understand there are those who may be making fraudulent claims, I really do, but I'm not one of them and I resent being accused and threatened on the basis that some other person has not been keeping their accounts up to date at my address. It is crazy and a waste of time and money. There are bad days in my life when I might not have been so able to deal with all of this and I still need to get into town to get some paper to print out those accounts which are now "paper-free" and I probably need another ink cartridge to do it.
Frankly, I'd rather be online trying to get more work in so I can earn more and pay yet more tax to finance the government and fellow citizens, but I have to stop and scan in copies off multiple accounts for several months for my own protection and spend this time on the phone trying to get to the bottom of this so-called "evidence" (which has still not been made clear to me) It is insane, exasperating, frustrating and, in my view, completely unnecessary.

Has any of your payments stopped?? Am in such a panic!

nikkif80 · 02/06/2015 13:16

I would like to know if anyones has been finalised yet or dealt with.
Concentrix have confirmed receipt of my docs last wednesday but said to ring in two weeks if not heard. I don't want to wait incase my payments stop or cut without being notified first.
They said my documents will be posted back to me also.

So has anyones being resolved yet? and D wilks912 when did they receive your paper work.

Hi just asking on behalf of a family member.

Received a letter from HMRC stating they believe her not to be a single person and requested evidence of her ex husbands new address as he never bothered changing his post over to the relative he is living with (speperated 18months ago)

Her tax credits both working & child have stopped and they don't deem the documents satisfactory to prove she is living alone with her son.

Would text and facebook messages be evidence to back this up as in a message from her to her other son to say ex has moved out dated back to the time of the break up

nikkif80 · 05/06/2015 13:45

Im not sure, but surely its not down to her to prove where he lives. But them to prove otherwise.
She could give them his new address and let them do the digging.

What evidence did she already provide? Utility bills council tax bills bank statements mobile account catalogues and sky or virgin, surely this is enough evidence is her name is on everything.
What she would need to do is take his name of everything, also ask him to change the address of his ongoing accounts to his new one.

Im guessing it would be hard for anyone with financial ties to cut altogether especially mortgages or existing loans etc.

babyalan13 · 05/06/2015 18:22

They signed for my documents on Tuesday but I haven't spoke to anyone so I don't no. Spoke to citizens advice today and he said 9 times out of 10 they leave your claim untouched

babyalan13 · 05/06/2015 18:24

Excitedforbaba? How many children does your friend have? I don't understand how they can stop child tax credit its really worrying

excitedforbaba · 05/06/2015 20:10

Just 1 dependant child the other has moved out. She was told all tax credit payments were being cancelled as of April last year so unless she wins the appeal will have to pay them back over a year's worth plus potentially a fine!

There is no council tax over here but all household bills apart from tv subscription Is In her name the issue seems to have been him applying for a loan with his bank which is still registered to her address. It's the only thing she can think of.

She has provided bank statements insurance certs for his new address but because they are recent they won't accept them as sufficient evidence that the marriage broke down when she put in her claim!

She now has 1 month to launch an appeal and send in any further evidence to support

babyalan13 · 05/06/2015 22:42

O my gawd that's awful. Is she working. I just don't understand it I've 4 children and married and their investigating me! I only earn 9 grand a year. Its so destressing

Flabulous that's a very helpful response I must say.... Confused

AmyElliotDunne · 06/06/2015 20:54

Flabulous, well that's genius. Just send what they ask for. Why didn't I think of that?

Oh wait. They've asked me to supply payslips, time sheets and my contract of employment. I'm self employed and have none of those! I'm a single mum working 3 jobs and apparently I'm supposed to have been keeping a daily diary of every minute I've spent sending emails, answering phone calls, wrapping and delivering parcels or every hour I've spent doing anything for one of my jobs, like its that simple.

stemsee · 11/06/2015 12:32

You can make a 'subject access request' to any organisation, under the data protection act. I did it over the phone and concentrix complied with my request fully.

SaraMullan123 · 13/06/2015 18:09

I can go one better. I wrote to hmrc in august and told them of a change in circumstances. They are still sending post to my parents address where i did live and i got a letter from concentrix to my parents house as well. Angry. Ive had to send another letter to hmrc to advise them of the changes and ive sent a copy to concentrix. This has given me untold stress.

zsazsa613 · 15/06/2015 05:47

How can I prove to Concentrix what I do on a daily basis in regards to new products I am inventing and the work I do prototyping them ? I spend a lot of time conceptualising and thinking through the processes in order to get the products 'design ready' for a manufacturer to put them into production. During this time I earn nothing and need Working Tax Credits to buy food. I am solely responsible for my young son. Concentrix and HMRC have backed me up against the wall stating that I have to prove what I do, but there is no way to do so. How do I prove that yesterday I cut waterproof PVC materials and sewed them together, or that I did some soldering the day before that, or that I spent all day on Adobe Illustrator the day before that trying to get the design right ? I am terrified we will be left starving with no money to buy food. Citizens Advice Bureau have not even heard of Concentrix. When I call Concentrix they tell me that they have no email address (but they are registered as an international IT company ?) and that I have to send them original documents.....of what ? How can I ? So I write to HMRC to complain that I cannot send 'original documents' for the work I do, as there are none to send. HMRC write back to say that I must comply with Concentrix's requests. This is torment. There is nothing I can do.

Excitedforbaba I've had both wt and ctc stopped due to insufficient evidence that was end of march I'm still fighting for what's mine I have one dd aged 12 and work partime so the only income I get is my wages and child benefit oh and the wonderful child maintenance that changes each week.tell your family member to get in touch with the CAB and her MP they will advise her what she should do.nikki yes it should be down to them to find things out they should be proving we are not single not have us do their jobs for them. I missed the response from fabulous, take it that it wasn't very helpful! Amy just send what you do have and a covering letter explaining what you don't have. I've sent my appeal off today so more stress playing their waiting game. It's disgusting they do this to us and not think of the consequences shame on them!

Lensy · 22/06/2015 17:14

Hello
I've had the same menacing treatment from HMRC about childcare costs. They put the same letter out to me twice, requesting the same information - I hadn't even claimed the childcare costs for the period they were checking! They threatened to stop paying my tax credits if I didn't comply, so I had to respond even though I didn't claim childcare! I spent over and hour holding to speak with them on the phone because they put the wrong postcode on my letter which left me with one day to reply or have payments stopped. We're all lone parents - it's disgraceful. Can anyone advise me where to sign the petition I read about please? THANKS!

Morgan97 · 23/06/2015 22:15

Hi lensy there's another thread about this a letter from concentric part 4,3 and 2 not sure how to link it just put it in the search at the top of the page,we are all in the same boat and the support is amazing x

kaz1986 · 25/06/2015 12:09

Hi there, I also received a letter from Concentrix on26th may 2015, we sent all the documents back on 4th June. We still haven't received any back and try ringing and all I'm getting is line is busy. Has anyone else received the documents back yet
many thanks

KatharineClifton · 25/06/2015 12:25

zsazsa613 and AmyElliotDunne I'm in the same boat. I can't prove that I have been working with time sheets because as self-employed I've never been required to keep them. I answered within the time given with answers to all their questions but am terrified they are going to ask for the last year of Tax Credits back.

Since the Concentrix letter I have stopped being self-employed and found employment in a care home. I don't know if they will stop my Tax Credits for the future. I'm going week by week seeing if I get any. Not heard anything back from Concentrix, and cannot get through to Tax Credits on the phone and have had to write to them with change of circumstances. And have to wait 5 weeks to be paid from employment. It's a bloody nightmare.

maiziesmummy12 · 26/06/2015 18:40

I have also had a problem with them I phoned in April to give yearly imcomes for me and my husband and when I receive the letter they had put out incomes complete wrong so I phoned back up and they said they will change it well it's now end of June and still not changed and I now have no payments they just keep fobbing me off all the time so my husband has written to watch dog to report them as o have never had this problem

2muskateers · 27/07/2015 11:27

I received a letter mid may requesting bank statements and payslips, i sent within a week recorded delivery, they then stopped my payments. The mistake they made was they haven't calculated my income over term time only and a simple letter from my employer stating i work 38 weeks per year but my wage is spread over 12 monthly payments will rectify the mistake. I have sent 2, they lost the first, i rang this morning to be told to ring back in 4 weeks as there is a back log!! 8 weeks of debts piling up, my daughters summer gone because they didn't read the information they asked for properly. i am so distressed i am having to have emergency dental treatment!! i have contacted citizens advice who said wait and sent a link to food banks!! and i emailed my local mp!! i cant believe they can do this to hard working people!!

Natt85 · 28/07/2015 21:30

I too have had no money for the past seven weeks! Paperwork tracked and shown as delivered on the 8th July. Called them last week, spoke to two different guys! First one too quick to get me off the phone. Second much better, apparently they hadn't received my paperwork. Then on second inspection said paperwork shown as delivered but honestly they hadn't got around to it yet as it wasn't on their system. Told if nothing within four weeks of paperwork arriving date (8th July) to call back! He did say once it is processed it can take just two days to go into account. Don't understand why it's taking so long!!
