Hi, I went to the jobcentre today for an appointment. I have a 16 month old daughter and u am due another daughter in 4 weeks time. I have been on income support since March of this year.
Every time I have gone to the jobcentre fir their review on my income support I have always stated that me and my child's father are still together although not living together. He stays 2-3 nights a week but does cone to see his daughter regularly. This gas NEVER been an issue before.
So I am now extremely stressed as today I saw someone different and told them the EXACT same things that I have always told the previous person interviewing me and I have been told I am committing benefit fraud!!!!!!!
That although my partner us registered at a different address because we are 'together' and expecting another child he has to support us. But i cannot understand why this has never been an issue before and how he can be expected to be able to afford to run 2 households? ????
Basically they have signed me off income support from today without checking my partners income or anything.
Please tell me they have it wrong and I can appeal. I am very very stressed at the moment wondering how I am supposed to pay bills and buy food etc. And like u said this is the first time my partner staying a couple of nights a week or coming to see his child had been an issue. Thank you for reading xx

Babiewho has said a decision maker will look at the circumstances? Nobody on the thread has mentioned anything of the sort. Confused

The rules, which have stood for 20-odd years, balance a range of factors and some of those factors are clearly in the OP's favour, including the fact that the bf pays rent and council tax elsewhere.

arsenic from what I can gather on the links you've posted- it just proves this couple are likely to be classed as LTAMC........

ArsenicSoup · 15/11/2014 22:07

I don't need to read it, Babie, I have worked with it.

OP needs to go through a process, starting with either appealing the decision or making joint claims, depending on the facts. She and the CAB can judge that best by considering all the facts and guidance, in confidence.

You are handing out such inaccurate advice, it is dangerous.

(BTW the words are 'baby' and 'agencies'.)

ArsenicSoup · 15/11/2014 22:12

It depends on all the facts Bear and the balance between them.

OP shouldn't post all relevant info here and so nobody here can say for sure either way. But it doesn't sound hopeless to me, by any means, based on everything she has said and previous cases I have seen. The fact that the original claim was based on an adviser's advice is also significant, particularly as far as any potential fraud investigation goes (I am not totally surprised they have said there won't be one).

But I also think your advice to OP re reconsidering her relationship is very sound Bear. He does need kicking off that fence.

Yes I will have to get as much information as I can. Talk to my partner to see whether he is prepared to give up his home and make our family official. And I won't lie I need to evaluate whether we are 'in a relationship' or whether it is just for the babies.
I do appreciate everyone's advice and I feel better than when posts were first coming in lol. Maybe it was how I was working things......

I know it means nothing but I do wish you luck OP, I genuinely don't think you are in this situation by choice and hope it works out for you.

coco2303 · 15/11/2014 22:30

Thank you again ladies for all ur help. Even though I didn't think this was the place to talk about circumstances etc I am glad that some of you have made me think about my 'relationship'. Whatever happens as long as my babies are fine that is all I care about.......
Please don't argue with each other even the 'professionals ' have given me conflicting information let's hope CAB can enlighten me properly on Monday.
And I can speak to my partner tomorrow when he comes round.........
