Mortgage Payments- Housing Benefit?

Hi all

My ex lives in the property we jointly own. I'm currently going through the Courts to sell it as he's accruing arrears on the mortgage. I have my own home (privately rented) to pay for so can't pay the mortgage. He just lost his job so now I'm worried the mortgage won't be paid.

Am I right in thinking he can claim SMI to cover the (interest only) repayments? The issue is that I am jointly named on the mortgage and I work- does that mean he isn't entitled to claim SMI?

with it being joint, does that not been you are both liable for mortgage payments?

If you are both on the mortgage then you are held responsible for the mortgage payments even if you do not live there. My SIL had a similar sounding situation to you, she contacted her mortgage provider and they were able to put a stop on the mortgage payments so that the weren't accruing anymore arrears (a payment holiday I suppose). But the house sale was going through so I guess they knew they would be getting their money very soon.

Have you contacted your mortgage provider they will be best able to advise you of what your options with them are.

They will have to take your income and out goings in to account as mortgage is jointly owned. We tired but was told no as we was over the wage limit for it. Just remember if he misses any payments this will affect you as well as it's joint and the mortgage company will expect you to pay it.
