Help please need hb advice!!

I need some advice.
Me and partner moved into rental property 6 months ago. We are both on tenancy and were both credit checked etc before we could move in. We have decided to separate after trying for months to make it work. He is moving back to his mums until he can find something permanent and I now face having to apply for benefits as I can't afford to run the place alone. He has agreed to top up money u til benefits are sorted and he will then look to rent somewhere himself. My problem is that he is on tenancy agreement- if I phone up and remove him I think we will be evicted as my wage alone wouldn't be enough and not sure landlord would accept housing benefit. Have been told I can claim without landlord knowing but how can I do this if his name is on tenancy? Terrified of
Me and my dd ending up homeless,please help!

Your landlord will find out if you're using hb, BUT depending in the way in which they pay it, it may be fine. Will they be paying you directly and you pay the rent? I can't see the problem if your circumstances have changed, provided you continue to pay the rent on time. At the end of the day, that's mainly what a LL cares about (DH is one on several properties):

Many buy to let mortgages will not allow tenants who get HB, so it could well be a problem for your LL.

On the form it says I can tick if I don't want landlord contacted? Thankyou for response just terrified at prospect of ending up homeless with a toddler.

Also, to add, I do earn enough to easily cover the rental payments each month and would always prioritise that payment above all other bills but would be entitled to a top up. Not sure if this makes a difference

Would hb allow me to make a single claim if partner still named on tenancy but I can prove he has moved out?

You probably need to get him removed. Easy enough, just tell the truth about you two splitting up.

Not quite sure how the mortgage company would find out if its a problem for them...but probably better that you are honest with the LL as he could/would eventually find out. If you are getting hb and have a toddler you would be right at the top of the list should the LL kick you out (and even then there are timelines he has to follow).

General consensus seems to be that the landlord will find out so looks like we will have to own up and hope

Hi there, none of my landlords have ever known that I claim HB, I just ticked the box you mentioned which asks the council not to inform them.

Also I went to my local council and said me and my partner have separated from this date. I used my tenancy agreement that has EX's name on too. Hope this helps, the people who you are to apply for HB are very friendly and will understand and help you.
