Neighbour built fence on my land? Advice pls

A couple of years ago my neighbour had a fence built between our 2 houses. It was actually built on our land giving her a larger garden, apparently in error, I was out when it erected. At the time I was pregnant and didnt want to make a fuss but now the damn thing is an eyesore and I want to pull it down and build one in the correct place. What are my rights?

If she built it on your land, then you have the right to ask her to remove it. Whose fence is it legally? If you look on your deeds, it should show who is responsible for which fence. If it is your responsibility, you can just remove it and replace with one of your choice. If it is her responsibility, you could ask her to move it to its correct position. However, as it has been there for a couple of years, it would probably be diplomatic to offer to pay for the replacement.

How much of your garden did it take?

Think as it is on our land it should be ours - it isnt on hers at all it is way over the boundary. If I ask her to remove it she won't as she is a very funny woman, no matter who has responsibility. Whatever we do she will kick up a fuss.

Do you have legal help attached to your house insurance?

I think legal advice would always be to write to her in the first instance.

You can also check with the land registry for a copy of the registration although it won't per se help in a boundary dispute.
