Redundancy and maternity pay

CuteLittleToes · 04/10/2013 13:02

Our company will be making some redundancies soon due to loss of some business. I might be affected too.

I know they will still have to pay my maternity pay in full, even if my contract terminates let's say half way through. However, would they still pay me for 39 weeks even thought I told I am intending to take 6 months? What about accrued holiday? Would it be paid as if I was on maternity leave for 39 weeks, 26 weeks (as intended) or just what was accrued up until the end of my contract?

Thanks for your help :)

Holiday pay will only be paid until the end of your contract, not throughout your maternity leave. Have you notified them in writing of your intention to only take 6 months leave? If so they will potentially only pay you for the 6 months. This is one of the reasons its better for you to let them assume you're taking the full 12 months (as they have to assume unless you tell them otherwise) and notify 8 weeks before you want to return. You may be able to tell them now that you have changed your mind and will be taking the full year, but they may not agree to this.

If you have only told them informally then you should still get the 39 weeks paid.
