hi my hub left me back in september the we have two houses i live in one and the other is on a buy to let that his mum was renting she is moving out on sat and i have just found out that he did not pay the morg with the money he recived for the last 3 months and he has put a iva on the proprty and has no intension of paying anything and its in negative ecity just dont know wot to do

i have and she said to take the keys of him witch im doing and going to get it rend asap but i dont want to pay the morgage off that he should off paid

he wants to sign both houses to me and im not sure if i should do it

Can you afford to take on both mortgages on your own? I suppose you could get a new tenant into the buy to let one to cover the costs. Will he be wanting anything when signing the properties over to you?

I would look at how much he has accrued in arrears at first, have you spoken to the mortgage providers?

I'm assuming he wants you to take it on hoping his mum can then continue to live in it. Otherwise by his actions not paying the mortgage his mum is going to end up homeless. What a prince!

he lives with his girlfriend now and his mum is moving out on saturday so im left with a emtey house and 3 months morgage arrease and if it is taken of us i will be lefted with more than £10,000 of debt so i have to rent it and live in hope just not fair that he is not paying any of the morgages

If your husband is in an IVA they will look if there is any equity to be released in year 4 of the IVA. Were you notified of the IVA company placing a restriction on the land registry? if not you should have been!!

www.bis.gov.uk/insolvency/personal-insolvency/individual-insolvency-register put his name in here and you can find out who his IP is - it might be worth having a chat to them and telling them he is not paying the mortagge

If you jointly own the properties they will come to you looking for any arrears anyway - sounds like you can't afford to clear it so it may well be best for you both eventually to take insolvency proceedings. It certainly doesn't sound as though you can afford both properties - is there any equity in the one you are living in?
