is anyone able to explain this regarding my oustanding holiday after matenrity leave

You went on maternity leave from the 14th August 2011, but gave notice on the 15th May 2012 as per your contract (one month) after being expected to return on the 21st May. You have not worked your notice.

  1. Any notice that runs after the date you were due to return to work, holiday can be used as part of this notice where not worked.
  1. Any entitlement of annual leave from last year not taken before you went off on maternity leave could be carried over, however only up to 5 days in accordance with the Capita policy. Bank Holidays are on top of this.
  1. So 5 days annual leave from 2011, plus entitlement from January 2012 to May 23rd/12x5 ? 10 days = 15 days annual leave in total due plus bank holidays are in addition and will include 5 from August 14th to May 15th = 20 days

Therefore the correct calculation should be 20 days paid annual leave offset against notice paid after 21st May to the 15th June but not worked.

I hope this clarifies and upon hearing from payroll that the matter is finalised.

Translation:

You can only leave work on a month's notice.

You have notice on 15th May but you didn't come into work for a month

Therefore you owe us one month of work

However we owe you 20 days' paid holiday (5 days annual leave you had from 2011 and carried over, 10 days you built up during mat leave this year, 5 bank holidays during mat leave)

So we will deduct the 20 days' paid holiday from the month's work you owe us

I expect they will want some money off you for the rest of the month Sad
